R-Squared has updated its comprehensive Compliance Quick Reference Guide for the Massachusetts Marketing Code. 

This version contains updates to the R-Squared Compliance Quick Reference Guide dated 1/29/10.   These updates include, among other items, new guidance from the Massachusetts Department of Public Health (DPH) per the DPH’s FAQs dated February 24, 2010. 

Specifically, the DPH addressed:

The definition of a Pharmaceutical or Medical Device Manufacturer (“PMDMC”);

Healthcare practitioner (“HCP”) review and correction of reported data;

Code of Conduct provisions, including provision of snacks at conference booths, performance of recruitment activities, and definition/scope of HCP; and

Reporting/Disclosure Requirements, including identifying employees of HCPs, manufacturer vs. labeler reporting, and response to unsolicited requests for information.
