Managing Vermont: Introduction to the Gift Ban and Disclosure Law

On June 8, 2009, the State of Vermont enacted a strict gift ban and expanded reporting requirements for marketing expenditures, which became effective on July 1, 2009.  These new requirements govern manufacturers of prescription drugs, medical devices, and biologics. 

The law prohibits gifts, including meals, under most circumstances and expands its existing pharmaceutical marketing disclosure law to include medical device and biologics manufacturers (and wholesale distributors of medical devices), making it the second state requiring so-called “aggregate spend” disclosure for device manufactures.
